I read a law book which gave a Common Law definition of burglary as: the breaking and entering of a dwelling house under cover of darkness with felonious intent.

The house part is important because it was assumed that a person would risk injury to defend his home and property.
The darkness part becaues a prudent person was prepared to defend himself during the day, but was at a disadvantage when attacked at night.

didn't ask, but find it funny that in 1891, it had a specific time of day where is was burglary. course back then if you had money, you had servants who would be home during the day.
i suppose there wasn't 'black on black'/lower middle-class burglary back then. or wasn't reported/delt with as 'burglary'?
 
The basis of English Common Law goes back to the Middle Ages. As time passed, ideas became more specific. At some point someone must have asked: when exactly is darkness? Kinda like what time of day are your car headlights supposed to be on.
The author gave an example of expanding the definition of home to include the outbuildings. You have an expectation of safety in your house: should people be free to steal the cow from your shed?
 
yeah, finding entries for this book or books that have rewritten the laws of this roman this and that book. and talks a lot of scottish law. all very ancient sounding. i think i may have posted some on this irish tome or something. too much to remember. and i am not a law person, THO, i did pick up an old law book on a curbside trash pile. did read the first case against what oil company was it? standard? carnegie? very sad case. poor wife done got blown up by that kerosene when she lit the stove. shit. i remember that.....heh.
kiled a kid too i think. and a baby survived and i wanted to know if they still lived.
